At McCracken & Partners Executive Search Inc. ("McCracken & Partners") an important part of our commitment to clients and candidates alike is respect for and the protection of individual privacy. We believe successful business relationships are founded on trust, mutual respect and candour; which means clear disclosure about the kinds of information we gather, how we manage this information and how we safeguard its privacy.

What is Personal Information?

Personal information is any information that identifies a person or by which a person’s identity could be deduced. Personal Information does not include the name, telephone number, email address or business address of an employee of an organization.

Why do we collect Personal Information from you?

We need the resume and other personal information you submit during the search and selection processes to:

Assess your skills, background and experience relative to the job opportunities for which the firm has been retained or may be retained in the future;

Maintain information so that we are able to contact you about a job opportunity for which you may be suited or know someone who you recommend we contact;

Provide you with information on new job opportunities.

How do we collect Personal Information?

We collect information only by lawful and fair means. We may collect personal information about you through the following means:

Directly from you when you submit your resume and / or other material electronically or in paper copy on an unsolicited basis;

Personal information you provide to our firm and any consultants acting on our behalf during the course of a search assignment;

Personal information you provide to us during the interview and selection processes;

Personal information that your references provide to us during the reference checking process

Personal information published and in the public domain; for example, on websites maintained by your employer and other organizations with whom you are associated and/or public announcements such as appointment notices, press releases, background material relating to speeches and other public addresses, etc.

Consent:

Consent for the collection, use and/or disclosure of personal information may be obtained orally or in writing and may be expressly given or implied. In determining how we obtain your consent, we will take into account the sensitivity of the personal information about you that we are collecting, using and/or disclosing. When you provide us with your resume, either in electronic or paper format, you are consenting to the collection and use of the information for the purpose set out in this policy.

We do not disclose your personal information to a client or third party to consider you as a candidate for a job opportunity without your expressed consent.

If you request in writing via the Privacy Officer (see below) that you no longer wish us to retain your personal information, we will delete your Contact Record and associated Notes / Histories, records of Activities, etc. from our central database and we will delete your resume from our records.

Disclosure of your Personal Information:

We may disclose your personal information:

In the normal course of business when you have consented to such disclosure; for example, to clients with whom you are interested in meeting and/or by whom you wish to be considered for opportunities;

To agents; for example, independent researchers acting for and assisting us in the execution of our professional obligations and mandated assignments;

If the information is already publicly known;

When we are required or authorized by law to do so.

McCracken & Partners will not sell, share or rent this information to anyone in ways that are inconsistent with the values, statements and undertakings set out in this policy.

Updating your Information:

Since we use your personal information to assess your background and experience relative to a client’s job opportunity for which we have been retained, it is important that the information be accurate and up-to-date.

If any of your information changes during the course of your career or your dealings with us, please inform us so that we can make the necessary changes.

Security of your Information:

We take all reasonable precautions to ensure that your personal information is kept safe from loss, unauthorized access, modification or disclosure. We operate secure data networks protected by industry standard firewall and password protection systems. Our security and privacy policies are periodically reviewed and enhanced, and only authorized individuals who need the information to perform their search responsibilities are granted access to your personal information.

Making Changes:

Whenever McCracken & Partners implements changes to this policy, the revised policy will be posted promptly.

Cookies:

“Cookies” are a form of software consisting of small amounts of unique data assigned by web servers and stored on your computer’s hard drive for later retrieval. In most cases, they are simply used to recognize you the next time you visit the assigning site and the purposes for which they are intended are usually benign. Also, via your operating system and/or internet browser, you are likely able to block and/or delete cookies from your hard drive. Nevertheless, cookies are generally assigned without your knowledge and consent. As such, we do not assign cookies, nor do we knowingly make use of cookies in any way.

Obtaining Access to Your Personal Information:

You may ask for access to any personal information we hold about you by submitting your request to our Privacy Officer. Summary information is available on request. More detailed requests that require archival or other retrieval costs may be subject to our normal professional fees.

Your right to access your personal information is not absolute. We may deny access, and explain why, when:

Denial of access is required or authorized by law;

Information relates to existing or anticipated legal proceedings against you;

When granting you access would have an unreasonable effect on other people’s privacy.

Correcting Errors:

If we hold information about you and if you can establish that it is not accurate, complete and up-to-date, we will take reasonable steps to correct it.
